Standard Conditions of Sale For AuctionExplorerBooks.com

  1. AuctionExplorerBooks.com act as a listing platform, auctioneers and agents for the Vendors. AuctionExplorerBooks.com is not in anyway held liable for the transaction between buyer and seller.

  2. We reserve the right to withdraw any lot before the sale, to combine any lots, to refuse bids, regulate the bidding, or reject an offer and withdraw the lot in question from the sale. We may bid on behalf of the Vendor for all goods, which are being offered subject to a reserve or at our discretion

  3. The highest bidder acknowledged by AuctionExplorerBooks.com will be the purchaser. In the event of any dispute between bidders, or in the event of doubt on our part as the validity of any bid or to re-offer and resell the disputed article. If any dispute arises after the sale, our sale record is conclusive.

  4. All property is sold “as is”. AuctionExplorerBooks.com and the Vendor do not hold themselves responsible for any errors of description, genuineness or authenticity of, or any fault or defect in any lot, and make no warranty whatsoever. No statement, whether oral or written, shall be deemed a guarantee, warranty or representation. A bid shall be taken as proof that the bidder inspected the lot and is aware of all faults, imperfections and errors of description.

  5. Care is taken to ensure that any statement made as to the origin, date, age, attribution and condition is reliable and accurate, however all such statements are merely of opinion and should not be taken as representations of fact.

  6. If a detailed condition report is wanted, then please contact the seller. AuctionExplorerBooks.com is not in anyway held liable for the transaction, description or sale process between buyer and seller.

  7. Notwithstanding the preceding conditions, if it is found that a said lot is a forgery, then the buyer must give notice in writing to AuctionExplorerBooks.com and the seller within 10 days of a successful bid. Proof of the forgery must also be presented. The buyer must then return the lot to us within 7 days of the successful bid and in the same condition as it was sold. We are authorized to and will rescind the sale and refund the purchase price. AuctionExplorerBooks.com reserves the right to dismiss at any time, without notice any seller that does not comply with our trade ethics.

  8. Books are sold with all faults, imperfections and errors of description, but if on collation any described printed book on our web-site is found to lack text or illustrations, the same may be returned within 7 days of the sale and the purchase price will be refunded. This shall not apply in the case of un-named items, blanks, half-titles or advertisements, nor to damaged bindings, stains, tears, or other defects unless these result in loss to text or illustration.

  9. At the stated end period of a sale, the highest bidder will be acknowledged by AuctionExplorerBooks.com. Subject to fulfilment by the bidder of all conditions set forth herein, will assume full risk and responsibility for the lot and will pay the full purchase price to the seller.

  11. There is no buyer’s premium / commission.

    AuctionExplorerBooks.com charges the seller $1 and 5% commission per listing. The sellers credit card will be debited one week after the auction has ended.

    The payee must insure that all money transfer costs are covered by the payee. Collection or shipment of goods will only commence upon receival of payment by the seller.

    Legal title will not pass to the buyer until the lot(s) have been paid for in full and AuctionExplorerBooks.com shall be entitled to a lien on any lot sold until the purchase is paid in full. If the buyer fails to pay in full, the lot(s) may at the seller’s sole discretion be re-sold.

    No purchase shall be claimed or removed until it has been paid for in full.

  12. Sales Accounts are to be settled within 5 days of a successful bid.

  13. AuctionExplorerBooks.com reserve the right to charge interest on accounts outstanding at a rate of 1% per month, together with storage and removal costs.

  14. A bid will be accepted by AuctionExplorerBooks.com via the online bidding system only. Neither a fax bid, nor a telephone bid will be accepted. In the event of identical bids being placed by two or more parties, the first bid received by us will take preference.

  15. Each bidder shall be deemed to act as principal

  16. No Bids can be reversed.

    Please note. When using AuctionExplorer.biz you are responsible for:

    1. The use of your username and password.
    2. Verifying the Bid and/or Proxy Amounts selected.
    3. Clicking the "OK" button when confirming (2).
    4. Being aware of the shipping costs and preferred payment methods of each seller.

    We suggest using extreme care and awareness when selecting, entering, and confirming a bid. These extra steps have been provided for your security.

    Bidding on the Internet is final and binding; just as it is in conventional auctioneering. AuctionExplorerBooks.com has been constructed with the same protocol, etiquette, methodology, and integrity as a traditional auction. We have decided that it's not up to us to rethink the system of auctioneering the industry knows.

    Vendors Conditions

  17. The Vendor (seller) acknowledges that by listing goods on AuctionExplorerBooks.com for sale by auction or by private treaty he or she has accepted and agrees to be bound by these Conditions of Sale. All goods listed on AuctionExplorerBooks.com will be deemed to be for sale by auction and are accepted to be sold at our discretion. The Vendor gives AuctionExplorerBooks.com full and absolute right to display the catalogued, illustrated and lots at their discretion.

  18. The seller is responsible for the description, payment methods and images of each lot he or she lists with AuctionExplorerBooks.com

  19. All goods are put up for sale with a minimum reserve of $20 other than this amount it is at the Auctioneer’s discretion unless the seller enters a higher amount in the AuctionExplorerBooks.com seller software prior to the commencement of the sale. No lots may be edited or changed once the auction is in progress.

  20. The Vendor authorises AuctionExplorerBooks.com to deduct commission, and expenses at the rate of $1 and 5% (of the hammer price) per lot.

  21. In the event of a reserve price not being met on the auction, there will only be a charge of $1 and no charge on the reserve price. No lots may be withdrawn from the sale after inclusion on the auction site

  22. Indemnity: The Vendor /seller shall indemnify AuctionExplorerBooks.com against any claims related to any goods sold on the Vendors behalf or held on behalf of a Vendor.

  23. Value added Tax

    At this stage AuctionExplorerBooks.com are not V.A.T. registered, therefore no V.A.T. is payable.

  24. Any statement as to authorship, attribution, origin, age, provenance and condition is a statement of opinion and is not to be taken as a statement of fact. AuctionExplorerBooks.com reserve the right, in forming an opinion, to consult or rely upon any expert or authority considered to be reliable in their respective fields.

  25. Timeframe:

    Bidding on all lots will take place over a 7 day period, unless otherwise noted on the lot page itself. The amount of time left will be indicated automatically.

    Micellaneous:

    Bidding will take place in increments of approximately 5%. The bid proxy may also be raised by any amount by the bidder. The bidder can raise his or her bid as many times as they like, without “bidding against yourself”.

    Contact the seller for the cost of the postage. Title of goods passes to the purchaser only following payment in full. Risk transfers to the buyer upon despatch and obtaining of a receipt from the Post Office or nominated courier service.
